前言
一 研 究 動 機
台灣已在2001年底加入世界貿易組織,正式成為全球經濟貿易一體化的成員之一,未來在貨品貿易、服務貿易以及智慧財產權等方面皆將遵行世貿組織的相關規定和決議,既享受一定的權力,也負擔相應的責任。
無庸諱言,世貿組織業已成為全球經濟貿易可持續發展的重要機制,全球有將近90%的貿易往來與其息息相關,不論是開發中國家抑或是已開發國家在其對外貿易政策上,皆須在世貿組織的框架下有序的、穩定的向所有的成員開放其市場的准入。
世貿組織的規則除適用於貨物貿易外,對服務貿易亦有其適用的餘地,烏拉圭回合多邊貿易談判達成的《服務貿易總協定》,是一項新的獨立的多邊貿易協定,在世貿組織中與《1994年關稅暨貿易總協定》和《智慧財產權協定》的地位是平行的。在《服務貿易總協定》中,首度把服務貿易納入多邊貿易體制調整的範疇,主要包括以下三大部分:一是協定條款本身,又稱為框架協定,由六個部分二十九條組成;二是八項附件;三是各國的市場准入承諾表。
服務貿易的內容十分廣泛,目前根據《1994年關貿總協定》各成員遞交的資料中所列舉的項目以觀,共有一百五十多種,大致分為十五類,其中包括國際運輸這一分類。另外,根據世貿組織統計和信息局1995年7月17日公布的服務貿易統計,將服務貿易業共分為十二個部門,此項分類已獲得世貿組織服務貿易委員會的評審認可,並將運輸服務部門納入分類,其中空運服務包括:一客運;二貨運;三包機出租;四航空器的維修;五客機的支持服務。不論各成員對服務貿易的分類或內容有何爭議,但對部分航空運輸服務業務的納入服務貿易範圍則無異議也明矣。
在《服務貿易總協定》的條款中所規定的義務分為兩種,一種是普遍性義務,另外一種是特定承諾的義務。普遍性義務包括最惠國待遇原則、透明化原則、增進開發中國家之參與、國內規章與認許、經濟整合、獨占及排他性服務提供的濫用、不加限制支付與轉移以及國際收支等等。
至於在特定承擔的義務中,則包括市場准入、國民待遇以及漸進自由化。此外,尚有一份承諾表,乃各國在談判的基礎上提交的關於開放市場的承諾,屬《服務貿易總協定》不可分割的一部份,具有法律上的拘束力。為了執行《服務貿易總協定》關於市場准入和國民待遇的規定,各國政府都提交了一份關於對服務業市場准入所做的特定承諾表。
在《服務貿易總協定》的八項部門協議中,與本論文有關的是《航空運輸服務附件》,這個多邊部門協議規定航空運輸可以不遵守《服務貿易總協定》關於最惠國待遇的普遍性義務條款,至於營運權以及與該權利的行使直接相關的服務則排除在《服務貿易總協定》之外,而且是繼續根據國際民用航空運輸協定的對等原則,以雙邊或多邊的形式相互給予航空運輸的權利。但有例外,即《服務貿易總協定》仍有適用於航空器修理及維修服務、空運服務的銷售以及電腦訂座系統等服務範圍內的餘地,簽署《服務貿易總協定》成員仍將受到此多邊協定的拘束。使得《航空運輸服務附件》成為在世貿組織架構下規範成員有關國際航空運輸活動事宜的國際法法源,並且成為對成員具有拘束力的多邊協定。
綜而言之,加入世貿組織不僅給台灣的經貿發展提供了機遇,入世後的應盡義務又對台灣的經貿發展提出了挑戰。機遇和挑戰並存,關鍵在於台灣如何利用機遇和迎接挑戰。其間對台灣最具挑戰性的問題,則莫過於近來喧騰一時的兩岸三通問題,然則此項問題與台灣的加入世貿組織究竟有何關連性,尤其是在通航一事上,是否可以在世貿組織或者服務貿易總協定的框架下加以推動,各種說法莫衷一是。本文的撰寫無非擬從法律層面上加以探討,並在相關的問題及觀念上予以澄清,以供參酌之用,而為本文撰寫時的動機所在。
二 研 究 目 的
本文在撰寫時所欲達成的目的主要有以下幾點:
(一)填補台灣在航空運輸法律這一研究領域內的空白;
(二)引發對國際航空運輸服務貿易的興趣及參與;
(三)瞭解各成員在世貿組織下有關國際航空運輸服務貿易的各項權利和義務;
(四)探究世貿組織架構下關於國際航空運輸服務貿易的問題和方向;
(五)剖析《服務貿易總協定》未來關於航空運輸服務業的永續發展方向。
三 文 獻 探 討
儘管西方法學發達的國家在國際航空法學領域上的研究已經是汗牛充棟,但就世界貿易組織架構下對國際航空運輸活動的影響及其永續發展,著墨不多。究其原因,不外目前規範各國在國際航空運輸活動領域內營運權的國際法法源主要仍以雙邊協定為基礎,區域性的或全球性的多邊條約涉及營運權實質內容的並不多見,導致在全球範圍內關於研究與分析世貿組織與國際航空運輸服務貿易的文獻顯然不足,造成本論文資料蒐集上略顯不足的隱憂。
惟鑑於台灣以及大陸均已加入世貿組織,在關於三通的極力呼聲炒作下,似乎在世貿組織的架構下兩岸的通航在即,引起不少具有爭議性的討論,就此點而言本文的研究與分析乃更見其重要性與必要性。
本文主要是涉及國際航空法律的各種問題,而國際航空法在台灣並非屬於熱門的課題,國內學者或實踐對此問題的研究專著寥寥可數,因此在查找資料或資訊方面必須有賴於對外國同類研究的協助與借重,甚至必須動用到對國際組織的各項聯繫辦法。顯然易見的是,本論文在搜尋資料過程方面係經由下列的管道以完成論文的寫作:
(一)國內學者、研究機構、國貿局或民航局的相關資訊;
(二)大陸學者、研究機構或民航總局的相關資訊;
(三)國外學術研究機構的相關資訊;
(四)各國民航主管機關的相關資訊;
(五)網際網路上的各種相關資訊
(六)各航空公司提供的相關資訊
(七)區域性或全球性國際組織的相關資訊。
至於文獻的種類,則包括專著、期刊、雜誌、報紙、法令、網際網路、國際組織的決議等等,取得文獻的來源則是圖書館、政府機關、網際網路、研究機構、大學研究單位等等,種類與來源尚屬充沛,但相關的文章或論述則不多見,惟對本論文的完成仍提供相當大的助益。
四 研 究 方 法
本論文將依循學術研究的嚴謹態度,從以下的法學方法論進行撰寫的任務:
(一) 通過歷史方法論,論證“航空運輸自由化”的利弊得失,以彰顯“航空運輸自由化”本身固有的特色。
(二) 通過歸納法,整理出“航空運輸漸進自由化”的進程中可適用的國際航空法原則,並著重對此等原則的分析、理解、運用、檢討和建議。
(三) 通過綜合法學方法論,將“航空運輸自由化”與“國家領空主權原則”緊密聯繫起來,充分突顯出營運權的主權特性。
(四) 從實證法學的角度出發,得出航空運輸欲達到自由化、一體化的不二法門的結論:即開放“國內載運權”以及放棄“主要所有權與有效控制原則”,以確保“航空運輸自由化”的永續發展。
五 預 期 結 果
按照世貿組織的原則,入世後,各成員可以享有的權利如下:
(一)享有多邊的、無條件的和穩定的最惠國待遇;
(二)享有普遍優惠制待遇及其他給予開發中國家的特殊照顧;
(三)利用爭端解決機制公平地解決貿易爭端;
(四)獲得在多邊貿易體制中參政議政的權利。
至於應盡的義務則包括:
(一)削減關稅;
(二)逐步取消非關稅措施;
(三)取消被禁止的出口補貼;
(四)開放服務業市場;
(五)擴大智慧財產權的保護範圍;
(六)放寬和完善外資政策;
(七)增加貿易政策的透明化;
綜合以上所享的權利與應盡的義務而觀,顯然世貿組織對航空運輸活動的制約有其侷限性,甚至上述的若干原則基本上根本無法適用到航空運輸的領域範圍內。職是之故,本論文的研究應可預期能夠達到以下的結果:
(一) 重要的航空運輸活動基本上是在世貿組織的架構外進行;
(二) 國際民航組織欲對國際航空運輸活動進行經濟管制仍顯力有未逮;
(三) 以多邊替代雙邊交換營運權的模式目前窒礙難行。
(四) 世貿組織仍將是已開發國家之間爭取本身最大利益的角力場所,開發中國家或低度開發國家仍只有拾人牙慧的份,利益的不均衡處處可見。故欲在多邊範圍內推動航空運輸的漸進自由化,仍待各成員努力以赴,未來航空運輸服務貿易的自由化仍將成為世貿組織成員定期談判的重要課題之一。
(五)新多邊體系的出現仍須假以時日,但區域性的整合則其重要性大增。
