John H. Jackson教授曾言：WTO/GATT現今所應達成之目標除了過去GATT設立時之二大目標避免戰爭、改善世界經濟外，尚應包括處理全球化所衍生之問題。而全球化之時代最重要的課題之一即發展。而全球之時代最重要的課題之一即發展。而WTO自GATT時代至今所面臨之問題與困境，皆是與發展之課題關係密切，從近期WTO部長會議會員間之紛擾及衝突看來，貿易與發展之問題已為亦為WTO所不可規避之問題。因此，本文之主要研究目的，在於探討與釐清世界貿易組織現今如何能對多邊貿易活動之參與國及相關主體，提供健全、公平與完整之發展機會和環境。 本文首先就全球化之現象為分析，其中說明全球化之特徵，其主要之支配思想為何，以及全琅時代所面臨之發展不均狀況為何，而包括世界貿易組織國際經濟組對於發展不均狀況之影響及關連為何。由於貿易與發展之關連及影響密切，故在次一章探討與分析GATT/WTO法律規範中所設定之發展宗旨內涵為何，而在過去至今之實踐中有無真正達到其制度規範目的與效果。同時，以歐洲聯盟迄今對外貿易與發展政策之實踐為借鏡，其實踐對於WTO之貿易與發展架構有無啟示性，而世界貿易組織對於發展之問題在第四屆部長會議所做成之「多哈發展議程」對於會間發展不均狀況之改善有無助益。接續一章則據前章之發現，對於WTO之實然與應然發展任務予以釐清，並從WTO之規範架構中重新確定其發展內涵。在對WTO發展任務之內涵為釐清與調整下，期待以WTO為主之多邊貿易架構，能為所有會帶來公平之發展機會與完整之發展面向。
Development has become on of the most important tasks of the world in the ear of globalization. As the most important international trade organization which plays the roles of regulator and coordinator of multilateral trade affairs, WTO can by no means ignore the consequences it causes to devlepoment. This article reviews the achievements and defects the WTO has brought and encountered on development, and tries to propose an ideal model for the developmental mission of WTO in the era of globalization. With this model it is expected member states of different developmental levels can have equal accessibility and availability to the necessary sources and chances for their development.
