　　　　　本文主要包括三個部分，第一個部分論述「消除婦女歧視公約」之發展歷史、保障之權利、國家義務及監督機制。第二部分則分析「消除婦女歧視公約」之缺失，其中包括各國提出保留之情形、國家報告之拖延及「公約委員會」結構缺失，並以兩性工作平等為例，探究為何「消除婦女歧視公約」無法深入建立婦女權利之實質內涵。第三部分探討「公約議定書」之歷史背景、制度及其是否可能改善過去之缺失。 本文認為「消除對婦女一切形式歧視公約」之通過及生效是追求兩性平等理想之建立，但是因為各國提出太多保留、各國報告拖延及「消除婦女歧視委員會」之結構性問題，卻形成兩性平等理想之失落，然而隨著「消除對婦女一切形式歧視公約任擇議定書」之通過及生效，未來將賦予個人申訴之權利及增加「公約委員會」進行詢問程序，或許這會是追求兩性平等理想重建之開端。
　　　　　This paper is comprised primarily of three parts. Firstly, if focuses on the history, individual rights, national obligations and monitoring mechanism of the Convention on the Elimination of all Forms of Discrimination against Women. Secondly, it examines the shortcomings of the Convention, and taking gender equality in work place as an example reviews the reasons why the Convention cannot establish fully substantial rights. Thirdly, it runs its analyses to the Optional Protocol to the Convention on the Elimination of all Forms of Discrimination against Women. This paper believes that the Convention's entering into force can be regarded as the establishment of the ideal of pursuing equality between two genders. However, due to such reasons as numerous reservations, delays in submitting reports, and structural problems of the Committee, the ideal has been lost. It is however argued that the Optional Protocol, which provides application right to individuals and inquiry procedure to the Committee, can be seen as a starting point to reconstruct the ideal of gender equality.
