This article focuses on Article 20 of the Fair Trade Law. In the implementation of the Fair Trade Law over the last ten years, the Fair Trade Commission (FTC) has accumulated a number of cases and established numerous standards and principles. This article introduces relevant theories regarding Article20 of the Fair Trade Law and presents related cases in practice. In addition, the U.S. has regulated the protection of “trade dress” for a long time, and has developed many valuable cases. In this regard, this article poses a few questions about the constitutionally-required conditions and remedies for the protection of trade dress in the U.S.. By comparing the institution of Taiwan and that of the U.S., this article provides an integrated construction. Last, besides the Fair Trade Law, there are numerous other regulations concerning trade dress, such as the Trademark Law, the Patent Law, and the Copyright Law, among others, and since these fall in the field of intellectual property and are connected with trade dress, they are discussed here.
