本文主要是分析與國家豁免主體有關之重要議題。除前言說明國家豁免主體的重要性與國家豁免原則的基本內容外，第二部分是由相關的條約與重要國家的國內立法，檢討國家豁免主體是否必須是一個主權獨立國家，並分析國家豁免主體與承認制度之關係。第三部份的重點是檢討豁免主體的具體範圍，其中，國家元首與國營企業的法律地位是討論的重點。最後，在結論部份，則是歸納重點，並針對我國的特殊情形，提出具體因應之道。
This paper is to analyze issues on subjects of state immunity. Part I provides background on the doctrine of State immunity, with emphasis on the importance of matters of subjects of state immunity. While Part Ⅱ reviews current judicial opinions, legislation, treaties, and relevant work of the nations and learned bodies including International Law Association and UN International Law Commission on subjects of State immunity, Part Ⅲ studies to what extent the subjects of State immunity cover under international law. Recent important cases relating to the Republic of China are also introduced in Part Ⅱ, and development on issues of head of state and state enterprise are surveyed in Part Ⅲ. In Part Ⅳ, general conclusions and recommendation on subjects of State immunity derived from the developments in Part Ⅱ to Part Ⅲ are present.
