亞洲水泥股份有限公司於新城鄉之礦業權於106年11月屆滿，依當時各主管機關之見解，於礦業權到期提出展限申請時，無須實施環境影響評估，且亦無庸踐行原住民族基本法第21條之規定。究竟依現行法規，於礦權展限案中，是否真無環境影響評估與諮商同意之適用空間？各主管機關是否「依法行政」？現行法規有何不妥適之處？本文將深入探討之。
