臺灣公職人員選舉罷免法第四十五條之五的立法原意乃是為了補助有 民意潛力但財源不足的候選人。本文的分析認為該條款在理論上並無法達成這項 使命，甚而有可能會導致社會資源的浪費除了對該條款的分析外，本文亦有系統 地檢討選罷法中本條款的相關條款。

　　　　　Sec. 45 (5) of the Taiwanese Election and Recall Law was enacted with anintent to subsidize candidates with good political potential but restrictedfinancial resources to participate in election. The analysis of this papersuggests that Sec. 45 (5) actually fails to help such candidates in electioncompetition. Moreover, Sec. 45 (5) may lead to inefficient uses of socialresources.
