本文探討德國公共行政科學的學科結構，論述的主要關懷在於行政法學與非行政法學的勢力消長變遷。大體而言，在第一帝國（西元1806年前）是警察學的獨大時期，行政法學在當時尚未納入公共行政教學中。 在由第一帝國過渡到第二帝國的時期中（西元1806 到1871年），行政法學在以君主立憲為訴求的法蘭克福國民會議之後嶄露頭角， 並茁壯到能與警察學在公共行政科學中互爭主流地位。在第二帝國期間（西元1871到1914年）行政法學一方面因君主立憲下的法治國家的理念，另一方面因第二帝國的行政改革，此一改革在很大程度上是建立在依法行政及依法審判的原則上，進而明顯地躍升為公共行政科學的主流及基礎學科，相形之下，傳統警察學則明顯式微。 在威瑪共和國期間（西元1914到1933年），上述行政法學做為主流學科的格局並無改變。這一時期，一方面行政法學在理論建構上更完善，而且行政法各論也被加以探討，另一方面大學學科中的（狹義的）行政學則被擱置，但與行政法學有關的社會科學所形成的（廣義的）行政學則在以行政實務為發展取向中找到新生命。在第三帝國期間（西元1933到1945年）及第二世界大戰後的前幾年，納粹政府及美軍當局曾以政治力干預公共行政科學的學科形構，但未有明顯影響。在德意志聯邦共和國期間（西元1945到1989年），行政法學的持續發展表現在行政法法典化的走勢，行政法在實體與組織的改變及行政法的準則等方面。行政學的漸受重視則表現在行政學教科書的再次出現，行政學教育機構的設立及行政現代化做為行政學的題材。特別值得一提的是，德國行政學在此一期間，一方面經由對美國行政學的接受及加工，一方面有鑑於行政官僚的不合理性，導致八○年代初有少部份學者極力主張公共行政科學應以社會科學而非法學為導向，並且鼓吹行政學作為一門獨立學科，但由於內外因素不成熟而告夭折。兩德統一（1989年）至今，因德國社會結構明顯變遷和歐體整合的速度加快，公共行政部門，行政法學及行政學更需強調調控，溝通及經濟性等功能。在這樣的背景下，行政法學界提出的反射法和行政學界提出的新公共行政及新調控模式，在此先不論其對解決問題的適用性有多大，至少它們都緊扣著強調增強行政法的調控功能及行政部門強調經濟性的必要性。在此一關連下，無疑的，以往公共行政科學中偏重行政法學的典範是正又受到激烈的挑戰。即使如此，當我們從歷史結構觀點來看，典範變遷的情形應該是以「怎麼上就怎麼下」的方式出現。就本文的論述關懷而言，德國公共行政科學偏重行政法學的典範的形成至今已有一百多年的歷史，即使目前有增強行政法的調控功能及增進行政部門的經濟性等要求，但短時間內，此一典範應維持不變。

　　　　　It is obvious that the science of public administrative law, not the scicnce of public management, is the main stream paradigm in the science of public administration in Germany. This paper tries to explain the reason why. Generally speaking, the science of public administration could be equalized to the science of police before 1806. The science of public administrative law emerged and matured rapidly in the wake of the issue of constitution. Especially after 1871, the socalled "rule by law" turns widespread in administrative and judicial fields. In comparison with the rise of the science of public administrative law, the science of police declines apparently. This has led to a new condition that the science of public administrative law turned out mainstream paradigm in the science of public administration in Germany. This condition remained up to the republic of Weimar (1914-1933), the Hilter's Government (1933-1945) and the federal republic of German (1945-1989). It should be stressed that the science of public management again had its seat since 1960s in Germany, however, it was, for example, up to the beginning of 1980s, not so strong as to issue a challenge to the science of public administrative law. With the dramatic change, the union of the two Germany in 1989 and the rapid integration of European Union, for example, the public administration in Germany faces a lot of challenges like reduction of mass unemployment and rapid reform of efficiency. In order to achieve these aims, the emphasis on the science of public management is inevitable. However, in the short run, it is undoubtedly true that the science of public administrative law stays a mainstream paradigm in the science of public administration in Germany.
