近代中國政潮洶涌,立憲頻仍,實驗了歐美成功憲制的諸多范例,然未嘗勝績。國民政府根據孫中山博稽中外的五權憲法理論,紹承清季以來的立憲之路。美國法儒龐德此時應邀來華,試圖以憲法文本的解釋與適用取代政治道德、政治權勢之變來實現憲法的制度化。其將三民主義解讀為國族統一、私權保障與服務國家。服務國家對應孫文之萬能政府;而私權保障則暗合孫文所謂"聽人民的話"。龐德借助這一契合重構民國憲制,從而導向其以盎格魯美國憲政民主模式為底本,因應服務國家中社會安全與個體自由衡平之需要的司法中心模式。具體而言之,即強勢且獨立的司法權、弱勢立法權、必要而節制的行政擴權這一服務國家理念下維持文明生活方式不易的憲制方案。
In modern China,we have experienced different constitutional modes which achieved great success in western country. However,none of them brought constitutional government for Chinese people. GMD government drafted Chinese Constitution according to Sun Yat-sen ’ teachings and recruited Roscoe Pound as legal adviser. Instead of political morality and political powers,Pound tried to take the interpretation and application of Constitution as the right way to constitutional government. As his analysis,the Three People’s Principle means Nation Unity,Bills of Rights,Service State. This interpretation just parallel with Sun’s omnicompetent government and People ’s rights. From this perspective,Pound tried to find a solution to keep balance between security and freedom in service state which sharp expansion of administrative power was inevitable. Pound suggested that strong and independent Judicial power,limited Legislation,expansion and controlled administrative power is the way to protect and develop civilized society and constitutional government for China.
