合憲性審查貫徹了法治和民主的兩重邏輯,由此合憲性審查在完成法治任務時帶有強烈的政治功能。司法審查模式用司法權吸納合憲性審查,在消解其政治性時讓司法權政治化;憲法法院采用集中審查的方式對前者進行改進;法國憲法委員會則是將合憲性審查嵌入政治過程。憲法的司法化讓合憲性審查成為重要的制衡性權能,這在法治發達國家有一定的合理性,但也造成很多難題。我國合憲性審查應立足于人民代表大會制度,內涵于全國人大及其常委會的權力,這就要求將其界定為程序性工作機制而非政治制衡性設計,基于此,我國應建立工作型合憲性審查制度。在我國,推進合憲性審查工作要在黨的領導、人民當家作主和依法治國三者的有機統一下展開,健全以全國人大常委會行使權力為主的工作機制,使合憲性審查做到"有案可審、有案必審、審查必嚴、違憲必究"。

Constitutional review shapes the constitutional order of a nation with the dual logic of rule of law and democracy,and the political function should be taken into account when designing constitutional review. The judicial review based on the rule of law dispels the political color through authoritative courts,but makes the judiciary politicization. To conduct a centralized review by the neutral and specialized constitutional court avoids the drawbacks of the American model. The constitutional committee in France acts in contravention and solves political problems through the political process. The judicial constitutional review gradually became the content of structural power allocation,forming an important political power with checks and balances. The constitutional review in China is conformed to the People’s Congress system and based on the power of the National People’s Congress and its Standing Committee,for this reason it is defined as the mechanism of work and procedure rather than checks and balances. Therefore,to improve the work of constitutional review in China,we need to ensure the unity of the leadership of the Party,the position of the people as masters of the country and law based governance,and optimize the working mechanism based on the exercise of power of the Standing Committee of the National People’s Congress.
