北約為救援科索沃免受塞爾維亞政府之鎮壓、迫害、種族清洗，乃於一九九九年三月二十四日至六月十日間未經聯合國家全理事會的授權，逕直對塞進行人道武力干預，此項軍事行動是否合法？其次要討論的問題是：戰爭已結束，科索沃應否獨立或留在塞國內？第三，科、塞間的基本衝突在於種族權利和歷史權利之訴求，這兩種權利能否同時解決？第四，人權(道)干預是否傷及主權，戰爭行為是否違反戰爭法，最後，推測科、塞間未來的可能關係。本文試就上述問題略作概述與分析。

　　　　　The policy on the part of NATO of using force to protect the ethnic Albanians in Kosovo against massacre, ethnic cleaning, rape and other systematic haman rights abuses by Serbian military force raises deep legal and moral questions in regard to the case of Kosovo itself and to a general doctrine of force and humanitarian intervention. This subject is rather complex, but we may here single out and deal briefly with five major problems derived form the NATO use of force in Kosovo: Was it legal that the NATO bombing campaign, carried out between March 24 and June 10 1999, was undertaken without specific authorization by the U.N. Security Council? After the war was over, should Kosovo be independent or remain a part of Serbia? Are there any solutions between historical and ethnic rights? Which is weightier, human rights or sovereignty? Did the NATO military benefits of attacking Serbia’s infrastructure outweigh the harm to its civilians? And finally, we discuss what are the latent relations between Kosovo and Serbia in the near future?
