本文從涉外監護之判決出發，依次檢討判決論理、我國學說通說見解、現行涉民法規定與修正草案建議。本文並從相關團際、歐盟關於兒童親權及監護權行使相關公約與判決承認與執行之角度出發，討論我國法上應有之修正方向。
From a comparative perspective, this paper focuses on the legal reasoning of the case WU of custody disputes. Departed from the common disciplines in international private law and the relevant regulations in Taiwan in comparison with other international conventions relating to the custody, it urges a better regulation and legal measures for the better protection of children's rights.
