　　近年來，隨著社會生活的不斷發展，有關婚姻家庭許多新情況新問題應運而生，而原有的法律出現了立法空白，在此背景下，2001年4月28日第九屆 全國人大常委會第二十一次會議通過了《中華人民共和國婚姻法(修正案)》，於4月29日起正式實施。修正後的婚姻法在結婚要件、無效婚姻、家庭暴力、夫妻財產制、離婚損害賠償等多方面對1980年婚姻法作了重要的修改與補充。婚姻法的修改不僅是內國法律制度的發展和完善，也對國際私法領域產生了一定的衝擊和影響。本文就此次修改新設立的無效婚姻、可撤銷婚姻制度，事實婚姻的認定問題，夫妻財產制，離婚損害賠償等問題對國際私法立法的影響進行了一定的論述，並在與臺灣及各國法律制度的比較研究基礎上對婚姻領域中國際私法立法提出了自己的建議。
　　In recent years, with the constant development of social life, many new situations and problems involved marriage and family occur, whereas the blanks of relevant litigation exist in the original laws. In this background, the ninth session of NPC Standing Committee put through “PRC Marriage Law” in April 28, 2001 which put into practice in April 29. The revised one made important amendment and complement to the 1980’s law in lots of aspects, such as marital elements, void marriage, family violence. marital property system, damages in divorce and so on. The revision is developing and completing the civil legal system. but also has certain influences on the field of International Private Law. This thesis deeply discussed the effects to litigation caused by the new-built system in this revision including void marriage, revocable marriage, cognizance of factual marriage, marital property system, damages in divorce, etc. Moreover it brought forward the suggestion of litigation in International Private Law in marital field. on the basis of comparing different legal system in different nations as well as Taiwan.
