財產犯罪是一個具有長遠歷史的犯罪類型，在法律制度的發展過程中一直扮演著舉足輕重的角色，在財產犯罪的變動軌跡中，我們也可以觀察到不同時代中的不同社會狀態。本文從歐陸法制史的角度出發，由羅馬法以下，而至近代的德國法，分別介紹財產犯罪在不同時代中的規定及內涵，期望藉由相關的解說，能夠掌握財產犯罪在發展上之脈動，進而作為同屬歐陸法系的我國在未來在財產犯罪研究上的一塊基石。 　　本文係就作者於2007年7月所提出的博士學位論文「刑法上之財產概念-探索財產犯罪之體系架構」中摘錄部分章節內容，重新加以調整及修正，並增加部分全新論述後而成，在此特別說明。

　　Property crime is a criminal category with long history. It plays a significant role in the developing process of the european legal system. By looking at the developmental process of property crime, we can observe the different social status in the different era. From the legal history’s point of view, we introduce the regulations and the intrinsic value 'of property crime in the different era respectively from the Roman law to the modern Germany law. As the same continental law system, we hope that we can understand the developing process of the property crime and then turn it into a cornorstone of the property criminal research for our country in the near future with supplemental explainations.
