隨著貨幣經濟與商品經濟蓬勃發展,債權漸趨活絡,「高融資時代」亦正式來臨,擔保之概念遂為現代人所重視,各國民法及特別法中率皆有擔保相關之規範。21世紀以來,同一債務人之債權多量化、重疊化及信用過度擴張…等問題致使債務之履行出現重大危機,是以債權更致力尋求多重穩當之擔保。本次民法物權編之修正,爰對共同抵押權之修正著力甚深。 新法為兼顧抵押權人,各共同抵押人、後順位抵押權人、保證人及一般債權人之利益,並考量程序經濟、程序正義,充分融資及社會經濟利益等因素,而根據各國的立法例,兼採各立法原則,例如自由選擇原則、債務人責任優先原則、分擔原則以及調整原則,雖較舊法完善,然其尚有缺漏部份,需待學說實務接手補足。惟確保債權實現根本之道,在於建立「信用社會」,如果能建立之,擔保制度即可備而不用,亦得將臺灣建立為「信用之島」。
Adapt to the flourish of currency economy and commodity economy, the claim also becomes active. Following that "Finance" also turns into the most important entry in these years, the concept of "Security" is proved to be valuable. Every country has related laws to security in their civil law and special law. Since the 21 century, problems such as debtors having surplus and duplicate debts or over-extending credits, which cause and enormous crisis to the perform obligation, are emerging frequently. Therefore, the credit is in search of a multiple and steady guaranty. At this agenda for correcting the civil law, the joint mortgage has been invested I plenty of effort. The corrected law consulted different civil law from other countries, thus to protect the benefit of mortgagers, joint mortgagers, junior mortgages, guarantors and creditors, and take procedure economy, procedure justice, adequate finance and social economic interests in regard, adopting multiple principles such as freedom of choice, priority of debtor's responsibility, participate and adjustment. Although the corrected one is much mature than the original one, it still has some deficiencies that need to depend on the retrieve of theory and practicality. Only by building a society of credit can ensure the performing of obligation, as well as the law of security can be prepared without used, thus make R.O.C. a Republic of Credit.
