Abstract In Taiwan and China, the grounds for patent infringement analysis are the Patent Infringement Assessment Guidelines and the Patent Judicial Interpretations announced by the R.O.C. (Taiwan) Intellectual Property Office and the China People's Supreme Court respectively. The main items covered by volume II of the Guidelines include: "claim interpretation", "all-element rules", "literally read-on", "doctrine of equivalents", "doctrine of estoppels", "practicing the prior art defense" and "reverse doctrine of equivalents". TheJudicial Interpretations also cover these items except for the reverse doctrine of equivalents. The content of the items in the Guidelines and the Judicial Interpretations are, generally speaking, similar but different in some details.
