市場調查乃是證明系爭商標是否會對消費者構成混淆誤認判斷最廣泛運用 的方法之一。但是市場調查之證據是否可以被法院接受,甚至進而發揮證明力, 則要根據相關的證據法則與法律規範而定。惟我國法對於市場調查報告之證據能 力,並無直接之規定,因此早期之司法判決否定市場調查之效力。近年雖有所改 善,但是究竟市場調查在商標爭議案件中能夠發揮的功能為何?是否對法院之認 定能產生直接的影響?則並不明確。 本文特別從歐美有關市場調查的相關判決與學者之研究出發,探討國際間對 市場調查報告在商標侵害案件中之地位與角色,進而探討我國司法機關對市場調 查態度的演變,使讀者對市場調查報告與商標侵權認定的關係有更明晰的認識與 瞭解。
