亞泥礦權的展限案，顯示了在『原住民族基本法』通過12年之後，原住民族的土地權仍難以真正落實，本文採取以結構焦點比較進行單一個案研究的觀點，運用文獻回顧與個案研究的方法，以紐西蘭毛利人的經驗為例，探討其整體的土地權主張機制，毛利人和礦業之間的關係，並分析毛利人如何可以參與採礦之決策與獲利的過程，以期作為反思台灣原住民族土地權之參考。

This article adopts a structured focused comparison perspective, taking the Maori experience of New Zealand as an example to discuss their land claim mechanism, the relationship between Maori and mining, and analyzing how Maori can participate in decision-making in mining. It can serve as a reference to the land rights of Taiwan's indigenous peoples.
