The increasing cross-border investment gives rise to increasing cross-border disputes. In judicial practice,
investors have a tendency to prioritize arbitration as an alternative dispute resolution, owing to merits of
arbitration such as flexibility, confidentiality, low-cost and efficiency. As preventive safeguards, arbitral
interim measures have gained recognition and popularity among senior attorneys. Hence the credibility of the
arbitration will be negatively impacted if arbitral interim measures are difficult to enforce. The same applies to
the confidence of cross-border investors.
