本論文旨在提供「博物館」(museum)一詞的法律定義，以供使用。所謂可供使用的法律定義，我的意思是一個法院可以用來區分何者為博物館，何者非博物館的精簡定義。此一定義之所以需要，頗為明顯。例如美國國稅局(The United States Internal Revenue Service)規定博物館為免稅機構，但並未予以定義(註1)。美國許多州和市鎮提供了若干有關博物館籌募基金的法令或條例，但也並未嘗試給博物館下一定義(註2)。由於「博物館」詞並無確定意義，國際條約上通常避免使用。(註3) 然而，博物館數目日益增加，全世界目前有一萬座以上的機構自稱為「博物館」(譯註一:根據「世界博物館名錄J」(The Directory of World Museurns)的估計，全世界的博物館數目在二萬五千座以上，超過本文所列甚多。)其中有半數是在美國(註4)(譯註二:根據譯註一之「世界博物館名錄」，全美共有博物館約六千座。)
