盡管網絡空間主權已經成為我國處理網絡事務的根本指針和制度基石,但其理論價值和法律意蘊均未得到充分闡明。面對與現實空間既區分又交融的網絡空間,國家主權既要堅持對網絡空間的適用性,反對消解主權的"網絡自身主權論"和弱化主權的"多利益攸關方治理模式",又要根據網絡空間"互聯、互通、互動"的特質適時而變:在內部主權的層面上,建構基本立法權、簡約行政權和類型化的司法管轄權;在外部主權的層面上,主張網絡安全、平等參與、共同利用、善意合作的國際法新秩序。
Cyberspace sovereignty has become a fundamental guide and institutional cornerstone for China’s handling of cyberspace matters,but its theoretical value and legal implications have not yet been fully expounded.Confronted with cyberspace,which differs from but is entwined with real space,we should insist on the applicability of state sovereignty to cyberspace,and oppose theories of the sovereignty of cyberspace which try to cripple state sovereignty and the governance model of multiple stakeholders that weakens state sovereignty.At the same time,we must change with the times in accordance with cyberspace’s features of"interconnection,intercommunication and interaction."At the level of internal sovereignty,we must construct basic legislative power,streamlined administrative power and classified judicial jurisdiction,and at the level of external sovereignty,we should propose a new order of international law for network security,equal participation,common exploitation and bona fide cooperation.
