作為"未成年人"和"殘疾兒童"雙重身份的學生,其受教育權的保障在很大程度上取決于家長教育權利的行使。美國《殘疾人教育法》及其相關法律對殘疾兒童家長的教育權利做出了明確、具體、詳細的規定。美國殘疾兒童家長的教育權利主要包括程序性保護及其知情權,教育記錄獲取、保護、銷毀權,教育參與權,教育救濟權,以及獲得指導、咨詢、培訓、服務的權利。
Because of the dual identity of minor and individual with disabilities, to some extent the realization of individuals with disabilities’ rights to education depends on the exercises of the educational rights of their parents. American act and its relative statues on the education of individuals with disabilities have made specific and definite education rights entitled by the parents of the individuals with disabilities. These rights include the right of the procedural safeguards and its information, the rights of accessing, protecting and destroying the educational records, the rights of education participation, the rights of education relief and the rights of getting the guide, consultation, training and services.
