The protective purpose of rules theory aims to limit the scope of attribution of negligent crime.The basis of this theory is to normalize the attribution of consequences.With its help,the judgment of attribution moved from the fuzzy life experience to normalized standards,thus playing a decisive role in the construction of modern criminal law attribution system as well as helping to restrict the establishment of illegal elements.In this aspect,the operation of permissible risk theory requires the assistance of the protective purpose of rules theory,which has an advantage over the incomplete theory of social equivalence.Moreover,the protective purpose of rules theory helps to explain the illegality of negligent crime.Specifically,this theory assists objective attribution theory to reconstruct the negligent crime.To determine the protective scope of rules,on the one hand,we should use the protective scope of rules as a starting point,on the other hand,we should differentiate it from a simple reflective effect.On the other hand,several theories debate on the obligation basis of the protective scope of rules including the formal obligation theory,the substantive obligation theory,and the normative limitation theory.For our country,in the framework of the principle of legality,it is appropriate to construct the protective purpose of rules theory with the model of the normative limitation theory.In the scope of application of the protective purpose of rules theory,it is necessary to oppose the overgeneralized "nihilism"and unrealistic"omnipotence"
