隨著我國少數民族傳統醫藥產業的不斷壯大,與世界其他國家之間的醫藥貿易往來不斷增多,對其進行知識產權保護顯得尤為必要。基於對我國少數民族傳統醫藥專利申請現狀的分析,我國少數民族傳統醫藥知識產權法律保護機制仍存在較大的完善空間。在少數民族傳統醫藥知識產權保護方面,印度和泰國為我國提供了立法新思路和保護新途徑;我國可制定少數民族傳統醫藥知識產權專門立法,建立少數民族傳統醫藥知識保護基金以提供有力的知識產權保護措施。

With the development of ethnic traditional medicine industry and the increase of the medicine trade, it is of great importance to initiate its protection of intellectual property. According to an analysis of patent applications of ethnic traditional medicine in China, there are still some legal issues to be improved in respect of intellectual property protection. The successful practice of India and Thailand can invoke innovations in legislation and protective measures for China. It is advised that China should establish special legislation of intellectual property of ethnic traditional medicine and set up protection foundation for ethnic traditional medicine knowledge.
