Abstract
The use of firearms by police officers is easy to become the focus of public opinion because of the lethality of firearms. It is not good for the police to be accused; therefore, the issue of guns used by the police should be dealt with.
This study is to achieve purposes below:
1.Review the current laws and systems for the use of firearms by police officers and propose an improvement project.
2.Understand and address the reasons for the decline in legal perceptions affecting police and judicial decisions.
3.Construct a reasonable and feasible "police use of firearms identification review system".
This study uses literature review, data analysis of judgments, comparative research and in-depth interview.
Finally, short, medium and long-term proposals are put forward. The short-term proposal means those methods immediately feasible, the medium-term proposal involves amending the law, and the long-term proposal is planning the overall system.
1.Short-term: establishment of the expert database, exclusive personnel to deal with follow-up matters, improvements of police education and training, and strengthening communication with the judiciary.
2.Medium-term: Law amendment to set up a police gun identification review panel, regulate the relevant norms of details, and designate Criminal Investigation Bureau as secretary unit.
3.Long-term: the review mechanism involves a wide range of disputes, and releases overall recommendations for police policy, measures and acts. In addition, the law amendment will include special, professional matters and those prone to bring disputes, and adopt advance identification and consideration system in order to avoid miscarriage of justice, reduce disputes, and establish judicial prestige.
