在歷經一九九零年代的六次修憲之後，台灣的憲政體制爭論仍然無法塵埃落定，逐步落實發展為民主政體下的立憲主義，在第三波民主化的國家中，屬於尚未穩定的憲政體制。本文從國內政治動態與國際結構交互影響的角度，探討憲政改造的機會結構，以理解台灣憲政體制演變的脈絡，並探索幾種可能的出路。本文提一個貫穿國際結構與國內政治的聯盟動態分析：一國的憲政秩序若欲穩固生根，其國內的憲政聯盟(constitutional coalition)必須取得多數民意的支持，而且其憲改主張與所處之國際秩序必須相容，這個憲政秩序才有可能成為政體最高層次的治理原則(the first-level order)，在其指導下展開政治體制的重整與民主遊戲規則的制訂。當國內憲政爭議的任何一方無法取得多數民意支持時，便只能在民主化的動態過程中迂迴漸進，此時互相競爭的政治勢力都會以憲政改革作為政治鬥爭的場域，犧牲了長治久安的憲政秩序。當執政者不斷的以制訂新憲或修改憲法，作為鞏固其統治聯盟(ruling coalition)的利益或圍堵其他政黨的手段時，憲政不穩定的惡性循環於焉展開。對外而言，國內憲政聯盟的偏好(preferences)與制度選擇必須與國際體系的結構、價值與理念相容，才有鞏固發展的前景。

Having gone through six rounds of constitutional revisions in the 1990s, Taiwan's constitutional controversy is yet to be settled and the prospect of a consolidated democracy is yet to be seen. This paper presents a coalitional dynamic analysis under which international structure and domestic politics are integrated in explaining the genesis and evolution of constitutional restructuring in Taiwan. Constitutional consolidation will only occur when domestic constitutional coalition obtains majority support and its preferences and institutions must be compatible with the dominant values and ideas in international society.
