　　　　　法律乃是政治過程(Political Process)中各種機構(institutions)的活動( activities)所衍生的政治力(Political Powers)互動妥協的結果，代表多數人 的意志(will of the majority)，其不在限制政府的權力，而是政府統治的工具 (instrument of ruling)。美國最高法院乃是美國政治多元體系(pluralist System)的一部分，並不能為保障少數人權而適用法律(包括憲法)來限制政府權 力的行使，對抗多數的情緒。基本上，法治乃是一種弔詭(paradox)，法律必須 以政治為基礎。
　　　　　Law is a final product of interactions and Compromises among political powers, that are originated from the activities of various institutions in the political process. It stands for the will of the majority. Rather than restraining the power of government, law serves as an instrument of ruling. The U.S. Supreme Court is an integral part of a pluralist system in American politics, it cannot apply the laws (including Constitution) to protect rights of minorites against practice of goverment power and emotions of the majorities. In essence, rule of law is a paradox, and law must be built upon politics.
