臺灣近年導入都市設計概念及實務，國人亦頗能接受都市設計經營有助於改善吾人 生存居位空間之作法。然而實務上，在眾多都市設計準則管制及都市設計審議之輔助下，都 市設計實務推行可謂舉步維艱，距離大規模實踐推廣尚極遙遠。都市設計實務推行之障礙極 少來自於對技術規範內容認知的差異，卻常來自於行政程序、有司權責、紛爭仲裁等制度性 問題。本文即嚐試由行政法學角度來檢證現階段之都市設計審議執行障礙之癥結。以釐清 大陸法系運作原理下的都市設計體制架構，並藉以描繪出公法、自治團體、民間、司法等各 關係主體在空間法制架構中之角色定位；並評估、建議改進我國都市設計制度運作之可能途 徑。

　　　　　The concept of urban design was introduced into Taiwan in the recent years. It is widely believed that the work on urban design would help a lot for improving our living space. But, with the support of urban design coding and urban design investigation, the practice of urban design is far from achieved on a large scale. The barriers for carrying out the ideal for urban design come hardly from the recognition for its technical contents, but susually from its administratvie procedure, competence, arbitration etc.---- systematic problems. This paper presents the evaluation of "Urban Design Investigation" on administratvie law, in order to construct the urban design system on legal system of continental Europe for Taiwan. Furthermore, some proper resolutions and suggestions for improving the urban design system in Taiwan.
