Proceeding from the case of "the Trolley Problem"as presented by Michael J. Sandel,this paper uses the perspective of a Marxist theory of value to explore the theoretical gains and losses in Western scholars’ answers to the "ethical dilemma"it poses and to the so-called "paradox of justice. "The paper’s analysis shows that the way the dilemma has been put forward and the difficulty philosophers have faced in answering it result from a disconnection between concepts and historical practice,especially the traditional value dogmatism in utilitarianism,liberalism,and virtue ethics. As a result,theoretical criticism has been hindered,and thinking led to the dead end of norm conflicts. This paper points out that with globalization and the building of a community of common destiny for all mankind,it is time for us to go beyond the limits of value dogmatism,to pay special attention to the subjective features of value norms,and to thoroughly understand the structure of multiple subjects. Moreover,with an accurate judgment based on the unification of subjective rights,we can overcome the limits of traditional thinking and thereby establish value thinking and value theories,including law and ethics,which are suitable to our current conditions.
