B2B電子交易市集為電子商務的一種類型,它提供買賣雙方透過網路進行交易 的場所,對市場競爭與企業開關係會產生深遠的影響,而有競爭法意涵。其基本營運模式是以解決廠商間交易所牽涉的六大活動為主,但是若進展到協同商務層次,電子交易市集的企業間主動加值服務就會擴及到線上共同產品設計。在商品市場,電子交易市集可同時產生提升經濟效率效果與限制競爭效果。就前者而言,基本上,電子交易市集把交易、採購過程標準化,商品 “證券化”,使交易過程廠商內外的交易成本得以降低。而且,電子交易市集作為 “eHub” 相互串連,不僅使市場資訊快速交流和彙整,提高市場資訊的透明度,而且使參與廠商得以提升接取市場能力,和進行良性的跨廠合作。因此,其正面效益包括行政成本降低、搜尋成本降低、開創新市場、供應鍊管理與優質化、與協同合作效益。電子交易市集在商品市場之限制競爭效果與電子交易市集的資訊分享、合作行為有闕,並可就資訊揭露與分享協議、聯合獨買 (獨賣)、與排斥競爭廠商參與等三方面分述之。另外,電子交易市集的網路效果、營運方式、相互串接等問題也會在電子交易市集本身所處的市場上產生公平競爭議題。以上述分析為基礎,本文將進一步探討電子交易市集之競爭法議題,並以市場的認定、聯合行為之規範等為重點。
The B2B e-marketplace is part of B2B e-commerce that provides a virtual marketplace by linking up both sides of business transactions, resulting in far-reaching impacts on inter-firm relationships and market competition. In its basic form, a B2B e­marketplace provides electronic solutions to the major activities that make up a business transaction. However, its functions can be upgraded so as to cover such an activity as on­line joint design. In light of all these characteristics, this paper aims to analyze both the positive and negative economic effects of the e-marketplace. We conclude the paper by pointing out the implications for fair trade regulations.
