網際網路世界與人類實體世界一樣，有著言論自由的問題、商業交易的陷阱、智慧財產權的侵犯、刑法及相關法律的違反，以及法院管轄權等問題，這些問題都隨著網際網路的普及而逐漸浮上檯面；而現實社會一直難以解決的色情問題，也挾著網際網路的高度互動、跨越國界、無政府、多媒體、高度隱私、匿名性高等特性下，如魚得水地進入網路世界，因而網路色情較其他產業發展更為迅速，影響也更為深遠。本研究除了對網路特性對色情的影響、網路色情的型態、色情網站的防制策略及相關研究等方面逐一探討外，在研究方法上，藉由參與觀察及內容分析法，就所搜集到的四二二個中文色情網站予以剖析，以深入了解色情網站之資訊取得方式、網站使用語言、網址註冊地區、IP位置、有無標示警語、網站主題、檔案下載方式、色情網站經營、交易模式、可能衍生之法律及社會問題，藉以提供偵查實務和制定管理法規之參考。

Same as human’s real world, the Internet also has problems of free speech, trap of commercial transaction, infringement of intellectual property, violation of penal code and related law, and issue of jurisdiction. These problems emerge following the spread of Internet, and the pornography evolve into cyberspace, accompanying with the characteristics such as high level interaction, crossing country boundary, anarchy, multimedia, privacy, anonymity. The Internet pornography develops rapidly than other industry, but the outcome is more profound. This study reviews the effect of Internet to pornography, the types of Internet pornography, the prevention and investigation of porn websites, and related research. We use participant observation and content analysis to profile 422 Chinese porn websites to thorough understand the information access method, language usage, registering area of domain name, IP address, warning message, theme of website, download method of file, operation and transaction model, possible legal and social problems of porn websites. It is hoped that this study can serve as reference of investigating practice and enforcement of management regulation.
