This paper, utilizing Constitutionalism, surveys the establishment and development of the Constitution of the People’s Republic of China, and especially focuses on the establishment and development of the Constitution before 1982, and between 1982 and the present. Moreover, it emphasizes that the democratic dictatorship of people and proletarian power are the premier conditions guaranteeing human rights; these premier conditions contravene Constitutionalism. And even though there are human rights clauses, the real situation is disconnected from those clauses. Finally, from the standpoint of Taiwan, it concludes that if Taiwan does not accept the reunification policy of “one country, two systems”, it is impossible for Taiwanese people to apply the human rights clauses of the Constitution of People’s Republic of China.
