本文討論準強盜罪的兩個問題：第一，強盜罪的原型，能否通盤適用於準強盜罪；第二，竊盜犯或搶奪犯所使用的強制手段，其程度必須與強盜一致，才能依強盜罪處罰。關於第二個問題，大法官的釋字630號解釋，基本上與本文的意見一致，本文對於「至使不能抗拒」的意義，也作了更深入的討論。

This paper deals with two issues concerning constructive robbery: first, whether the prototype of robbery can universally apply to constructive robbery; second, only when the degree of the forcible means employed by the larcenists or forcible takers is in consistence with that of robbery can they be punished with offense of robbery. With regard to the second issue, the Interpretation No. 630 of the Judicial Yuan generally agrees with the ideas presented in this paper. This paper also presents a further discussion toward the meaning of 'rendering resistance impossible.'
