台灣加入GATT/WTO的關鍵法律文件主要爲1992年GATT理事會就台灣入會議題成立工作小組之會議紀錄，以及台灣當局於2001年所簽定具法律契約性質的入會工作小組報告(Working Party Report)。本文試圖檢視這兩份關於台灣入會的關鍵法律文件，就實際的角度，檢驗台灣的「去主權化」在此一動態的國際政治過程中呈現的法律意義。同時，更將輔以國際法院(International Court of Justice)司法實踐的案例，透過「禁反言原則」和「默認原則」等的法律效果，探討台灣相關片面認諾所產生之強制效力。作者期待，可以藉此回顧台灣入會這個極其特殊又對未來具深遠影響的過程。
There are two key documents dealing with Taiwan's accession into GATT/WTO. One is the proceedings of conference of GATT's Council of Representatives to establish a working party to examine the request for Taiwan's entry in 1992. The other is the Working Party Report signed by Taiwan administration in 2001 as a legal contract. The author shall examine the impact of this influential and far-reaching process of Taiwan's accession into GATT/WTO from a practical point of view. He will explore the legal significance of deprivation of sovereignty and the legal effect of Taiwan's unilateral acceptance of the terms of entry in this dynamic international political process. This is examined by reviewing the two key documents of the accession of Taiwan, as well as with the assistance of legal practice of International Court of Justice with respect to the doctrines of Estoppel and the implied consent.
