由於世界各國在電信自由化之趨勢下，開始立法或修改本身之電信法規範並將關注焦點放置於頻譜資源的利用與管理，因頻譜資源有其特殊性質，故須以一套管理機制及基於此機制所建構之法制度反映頻譜資源之特性，而各國在無線電頻譜管理制度之建構上，皆特別關注頻譜資源之經濟分析，以期建立起一套完備的頻譜管理模式，故本文主要透過對頻譜資源管理之制度分析，以頻譜所具備的獨特性，尋求最適切之頻譜管理模式，確保頻譜資源的有效利用。而健全的頻譜政策須瞭解其核心議題並考慮到不同制度的優劣，此即本文探討的主要焦點，其次在於回顧不同頻譜管理模式及其方法，藉由討論不同的頻段管理模式，以此提供相關產業關鍵意涵的比較分析，但各國就相關制度之實施仍處於不斷變動之狀態，故本文期待以國外學說為基礎，以無線電核照收費方式及其使用權利範圍為核心，提供未來在相關議題上之參考，最後並提出制訂「頻譜資源管理法」之構想。
Following with the trend of telecommunication liberalization, many countries had proceeded legal reforms of telecommunication law with focus on the use and management of spectrum resources. Due to special and unique characters of radio spectrum, the management of radio spectrum resources and its utilization should be well established by suitable regulations. For this purpose, developed countries had emphasized the legal economic analysis of spectrum management and sought for the best solution for management models for spectrum uses. However, each model and system for radio spectrum managements has its own advantages and disadvantages. To consider the side effects and economic efficiency, the article will debate different models, trace telecommunication industrial developments, and then present the recommendation and conclusion with the focuses on spectrum funding, spectrum pricing, spectrum fees, and spectrum rights.
