女性在犯罪體系最常被以「加害人」與「被害人」進行研究。在研究的進程當中，刑事程序中的警察、檢察官、法官、律師，以及社會運動的發展，最終至女性主義學者的見解，都在在地對女性爲何犯罪以及爲何被害做出不同的解釋。本文將所有涉及的程序作一番粗淺的介紹後，藉用統整的方式將其中的共通點提煉出來：無論程序、運動、學說如何運行，其實都是在傳達特定的一種女性主體的「知識」，知識如何形成和運作，以及不同的犯罪有何共同的知識傳遞是本文的研究重心。在將女性主體的模型描繪出來後，本文將指出在女性作爲母親或類似母親角色將產生選擇上的不自由，且最終無法逃脫的知識陷阱，藉由偏見與知識的交錯描述，本文期待能夠讓法官瞭解女性案件中對女性的偏見（不同於社會大眾之偏見），進而影響法官的決斷、限縮法官的知識偏見作爲解決的依歸。

Women have always been studied as offenders and victims in criminological research. All the actions performed by criminal justice practitioners, the development of social movements and the ideas introduced by scholars always provide different explanations of why and how women get involved in criminal cases. However, the knowledge about female offenders and victims is undoubtedly the most horrible entrapment in our society, which is constantly reinforced by feminism and social movements. This article explains how the knowledge is formed in our society and how the traditional role of mother reduces women's liberty. Expecting the appropriate way to moderate the severe situation woman faced could be exigent in our law system.
