合理使用（fair use）向來被視為是反駁著作權侵害指控的最大利器，合理使用一向被人詬病使用範圍不夠明確且定義不清，美國法院則以此作為因應新科技的判決解釋利器，然而在適用上的疑義與範圍，徒留許多模糊地帶，加拿大則至2010年提出的修正草案才對合理使用有更進一步的明確規範。雖然案例法國家可以由法官造法的方式，甚而常在判決結果上令人面目一新，但由其結果歸納與訪查其脈落軌跡，對臺灣學理與實務亦有實益。本文以美國及加拿大著作權法相關法律適用及實務判決，並佐以美國及加拿大文獻、法規，就合理使用原則之理論為核心，對臺灣法作出建議以為結論。

Fair use has been invoked as a defense to claims of copyright infringement over the past years, many criticize fair use doctrine as unpredictable and indeterminate. Government of Canada introduces Proposals to Modernize the Copyright Act until 2010 to extend the meaning of ＂fair use＂. This Article examines fair use case law through the lens of the doctrine's chronological development in US and Canada.
