     本論文的研究目的,在於從經濟解僱與就業保護間的衝突和矛盾,尋求一 個平衡點,以作為臺灣制定有關經濟解僱,如集體裁員或關廠之相關法律時的 重要參考。本文的主要核心論點,乃經濟解僱保護法應內部化經濟解僱行為所 產生的外部成本,至於內部化的手段,則應兼顧勞工與雇主的權益,不應有所 偏頗。本論文從經濟解僱保護立法的學理爭論出發,並以國際比較研究的方 式,尋找普遍為各國所採用的經濟保護機制,尋求其立法的脈絡,最後,本論 文提出相當具體且有價值的研究發現,可供我國制定勞動保護立法之參據。
     The purpose of this study is to find a balancing point between the conflict of economic lay-offs and job security. It is meant to provide an important reference for Taiwan to establish laws related to economic lay-offs, such as collective labour discharge, or plant closure. The central argument of this artile is that the protection law for economic lay-offs should internalize the external cost created by such economic lay-offs. As for the method of internalization, it should well protect both the labour and the employer, and biased towards neither, This article starts with the theoretical debates regarding the protection laws for economic lay-offs, then, inverstigates the economic protection machinery. generally accepted by most nations, and their trend of legislation, Finally, the article provides a substantial. and valuable research finding, that would provide a reference for our nation's legislavtive process to establish labour protection.
