未來我國民法典物權編應維持現有的擔保物權體系,不應將非典型擔保納入其中。擔保物權人的優先受償權不應隨意遭受貶損。擔保物權總則的內容應當予以完善,剔除那些并非擔保物權共通規則的內容,增加對擔保物權不可分性的規定,將擔保物權人物上代位權界定為法定債權質權,允許當事人約定擔保物權的存續期間,明確擔保物權因主債權訴訟時效屆滿而消滅,并認可混合共同擔保中擔保人之間的追償權。就抵押權的完善而言,應當允許民辦學校、幼兒園或醫院以教育設施、醫療衛生設施等抵押,規定抵押權的效力及于抵押財產的從物、添附物,認可流押契約的效力,完善抵押權與租賃權的沖突規則,增加對共同抵押權的規定。未來我國民法典物權編應當增加金錢質押的規定,明確票據和倉單質權的設立要件及界定應收賬款的范圍,明確規定特定情形下債務人消滅留置權的權利,明確留置物被抵押時留置權也優先于抵押權,縮短債權人給予債務人的寬限期限。

Civil Code of the People’s Republic of China should maintain the existing system of secured property rights. Security transfer of chattel should not be stipulated in the Civil Code. The priority of the security owner should not be derogatory. The contents of the general rules on secured property rights should be perfected,such as excluding those provisions that are not common rules for secured property rights,providing the indivisibility of secured property rights. The subrogation right of the secured property right person should be defined as the legal pledge of obligation in Civil Code. The parties have the right to agree on the period of existence of secured property rights. The right of secured property will be extinguished by the expiration of the limitation period of the main obligation. The guarantors of mixed joint guarantee have the right of indemnity. In terms of the perfection of hypotheca,private schools,kindergartens or hospitals should be allowed to mortgage education facilities,medical facilities and other facilities. The civil code should stipulate common mortgage and effectiveness of the mortgage right and the attachments to the mortgaged property. Further more,the validity of the contract of detention should be recognized,the conflict rules between the right of mortgage and the lease should be stipulated. Civil Code should provide pledge of money,clarify the elements of creation of pledge of bills and warehouse receipts,define the scope of accounts receivable,stipulate the rights of the debtor to eliminate lien under certain circumstances,The lien also takes precedence over the mortgage of the same property. The grace period that the creditor gives the debtor should be shortened.
