近年來網路犯罪時有所聞，以網路排謗案例，由於網路訊息散佈快、使用者匿名，使得個人更加自由而無所顧忌的發表言論，但是這些謠言卻有傷害商譽與誹謗之虞。本研究的研究目的在於從網路謠言的角度切入，探討國內外網路排謗的案例，企圖歸納出網路詩謗的類型及其特殊性，並就排謗的法律面，針對因網路不當言論而可能觸犯我國排謗刑責的法理或法源依據，做一個深入討論。本研究所採取的研究方法為案例分析法。除了介紹我國關於排謗的相關法律外，並對實際發生的個案做分析與比較。以本研究所選的案例以發生在台灣本國島主，共有五個案例，美國案例二例鳥輔。本研究將網路排謗分為個人恩怨型、醫療糾紛、破壞商譽、監控疏失等類型，最後，本研究認為，對抗網路排謗與傷害名譽的言論，法律並非唯一的解決的途徑，善用網路媒體的特性，並輔以法律制裁才能真正阻止網路謠言所造成的傷害。

Crimes in cyberspace occurred from time to time. Defamation, for instance, is one of these crimes. Because of the characteristics of Internet i.e., fast and anonymous, some users make rumors freely. Sometimes rumors become defamation. The purpose of this study is to examine rumors in cyberspace and discuss seven cases of defamation in cyberspace in Taiwan and in the U .S. We categorized defamation into four types in cyberspace: personal resentment, medical treat-disputes, commerce reputation damage, supervision negligence. In sum, the researchers concluded that law is not the only way to solve the defamation problems in cyberspace. Taking advantage of Internet and defending oneself with law maybe the best way to avoid Internet rumor damage.
