Under classical international law regime, individual is not a legitimate subject to bring actions based upon causes provided international law. But since the twentieth century the absolute theory was the subject of the regime is constantly challenged. The subject of international law shall not only be the state but also other partial and in complete ones such as non-state actors like individuals. Personal compensation claims against nations which infringed human right during World War II in Asia is also under intensive discussion. This issue is inherently related with individuals as a legitimate claimer under international law regime. This article will discuss the related concerns based upon the practice mainly against post-war Japan. The compensation issues of peoples in Ryukyu during the 228 incident will also be concerned.
