題名:管制與革新: 日本與美國金融自由化的政治分析

自從1997年亞洲金融風暴發生之後,金融管制與革新便成為國家之間最重要的議題,本文的主要論點認為:不同的金融管制措施會改變國家、企業與銀行的互動關係進而影響到金融體系的穩定,而在現今金融管制仍然屬於個別國家的國內管轄制度,尚缺乏一套國際管理機制的情況下,便有必要從國家內部的金融管制與革新來分析其對金融制度的影響。本文將從金融自由化以後,國家對銀行與企業之間的相互持股及銀行與資本市場相互介入兩種金融管制面向,來比較日本與美國不同的管制革新措施對政府、企業與銀行互動關係的轉變,並以1980年之後日本對證券交易法第六十五條與及美國對格拉斯--史帝格法案的存廢為例證來分析其背後的政治意涵,以驗證理論的假設。本文主要的結論認為日本主要銀行體系的基礎在於企業與銀行的交叉持股關係,在未有完善的監督體制下,廢除證券交易法第六十五條,讓銀行介入證券投資業務將會加重銀行的不良債權造成銀行危機。而美國專業分工銀行體系的基礎在於區隔銀行與資本市場和企業的關係,同時以銀行控股公司來管制銀行與企業的互動關係形成內防火牆,因此若廢除格拉斯--史帝格法將會有助於提升銀行體系的競爭力。
