本文乃欲研究國家人權機構作為違憲審查替代方案的可能性。首先本文先簡單釐清人權委員會與監察院定位之爭，提出另一觀點，認為可以將兩機構合併。以做為目前權限爭議的解決之道。接著則繼續比較人權委員會與違憲審查兩者在維護人權上的功能，本文認為，在人權保障的功能上，違憲審查的效果比仌權委員會差，卻要耗費比較多的資源成本，故本文大膽建議以人權委員會作為違憲審查的替代方案。

I want research the possibility that national human rights institutions replace of judicial review. First part of this article, I try to explain the difference and the sameness of human rights commission and the ombudsman, and offer the alternative solution to figure out the power-conflict problem between the two institutions. Second part of this article, I try to analysis the functions of judicial review and human rights commission. I propose that the human rights protection function of judicial review is less than of human rights commission, but the cost of judicial review is more than of human rights commission.
