隨著網路電子商務風潮的形成，網路的利用也產生了許多新的法律問題。其中有諸多與公平法有關的法律問題。不過，若深入分析與網域名稱相關的公平法問題，則可將其區分為二種主要的頭型，分別為：(1)壟斷問題，與(2)不公平競爭問題。 就前者而言，由於國際問已經朝向劃分網域名稱登錄管理單位 (registry) 與受理申請單位 (registrar) 功能，故作者建議在我國電子商務快速發展的情況下，仍應配合國際發展趨勢方為上策。而在與網域名稱方面，作者認為可利用公平法第二十條與第二十四條規定與相關行政命令加以解決。由於網域名稱相關的不公平競爭模式仍不斷出現，因此如何將現有規範加以適當的解釋以解決此等新興的問題，則將是較另訂新法更迫切的問題。

Accompanying the rapid development of E-commerce, mew legal issues merge alone the information highway that leads to the cyberspace. These newly appeared legal issues have different characters and traits that are not necessarily regulated by the existing laws/regulations, nor expected by legislators. Among the cyberlaw issues, many of them are unfair competition related issues. For example, domain name, mettag, hyperlink and framing techniques are all related to unfair competition. In analyzing domain name related issues, however, the author distinguishes two types of issues that are worth exploring. The first one is whether the domain name registration body is Taiwan, i.e., TWNIC, has monopoly power and whether it has exercise that power to exclude competition? The second issue is an unfair competition issue, that is, whether cybersquatting constitutes unfair competition under Taiwanese Fair Trade Law? For the registration issue, the author argues that the international trend is dividing domain name registration and regulation into two separate bodies, i.e., registrar and registry. Even though FTC ruled that TWNIC does not violate the Fair Trade Law, the ruling apparently overlooked the international trend that separate the registrar and registry. The legal issue, therefore, will not change even after TWNIC has reorganized itself from an ad hoc body into a legal entity. For the unfair competition issues, the author argues that the Article 20 and Article 24 can be applied in resolving may legal issues arising from the so-called "cybersquatting" activities. It is important, that FTC develops applicable rules to regulate this kind of unfair competition activity in the cyberspace.
