電腦與網際網路的發明，對傳統隱去權概念產生極大的衝擊。無論是最早開始建構現代意義的隱私觀念的美國，或是對於依循大陸法系概念的我國，隱私權保護法制面對日新月異的資訊科技，總有捉衿見肘之感。本文嘗試探討三種隱私權的基礎理論，亦即基本權利觀點、經濟分析觀點，以及社區導向觀點，並分析社區導向觀點較為合適成為資訊時代之下建構相關隱私權保護法制的基礎。接著並將以文中所述之相關理論，對我國的現行隱私保護法制做一簡要之評論。

The invention of computer and the Internet has made great impact on traditional ideas about privacy. It always seems that the mechanism of privacy protection cannot catch up with the rapid changing information technology. This essay analyzes three theories of privacy, i.e. the fundamental right perspective, the economic analysis perspective, and the community-oriented perspective. This essay argues that the community-oriented perspective is better suited as the foundation to establish the mechanism of privacy protection. In the conclusion, this essay also makes a brief comment on the current privacy legislation in Taiwan.
