歐盟基於消費者權益、食品安全、公平競爭、市場效率、環境與生態保護等考量,對於基改食品採取強制標示。歐盟消費者權利的保障已規定於歐體條約第153條。基改食品強制標示顯示歐盟針對消費者權利,已非形式上法律規定,而是藉由資訊揭露與大眾參與基改食品決策,具體落實消費者權利保障。歐盟模式對於發展以消費者權利保障為導向的基改食品國際規範,以及建構歐盟公民社會,提供了新的啟示與新的願景。
Labelling is compulsory for genetically modified (GM) food in the European Union (EU), based on principles associated with con-sumer rights, food safety, fair competition, environmental protection, etc. Consumer rights are explicitly provided for in Article 153 of the EC Treaty. GM food labelling is seen to demonstrate that consumer rights are protected through information disclosure and public par-ticipation in the EU’s policy-making procedures on GM food. As the Lisbon Treaty commits the EU to pursuing common policies in its ex-ternal relations to safeguard its interests and contribute to the protec-tion of its citizens, it is expected that EU practices, based on consumer protection and civil society, will have a substantial impact on interna-tional GM food labelling regulations.
