本文首先介紹全球各主要國家及我國在使用基因資訊於保險核保上的監理規定，而後提出贊成與反對保險業採用基因資訊的法理論述。當日後民眾為應付老年疾病以獲得醫療照護，而普遍購買長期照護保險或重大疾病保險來滿足其醫療需求之際，基因資訊應用於核保上的問題將變得日益重要。因此，瞭解目前各國保險公司使用基因資訊的監理規範，以及釐清使用基因資訊於保險核保上爭議之所在，當有助我國未來制訂基因資訊政策之參考。

This paper set to examine the regulation pertaining to the occupation of genetic information for insurance underwriting in Taiwan and the rest countries of the world. After that, the legal rationale of positive and negative points of view bearing on utilizing the genetic information in insurance industry was discussed. Looking forward, when it becomes pervasive situation that people purchase the long term care insurance and critical illness insurance to cover medical care expenses, then, the issue mentioned above should turn to more essential. For future's policy making purpose, it is necessary to clarify and understand the contemporary regulation concerning apply genetic information to insurance industry.
