我國近年來網際網路的發展十分迅速，網際網路互連的議題亦漸引起人們的注意與重視，尤其是在ISP產業結構嚴重失衡的我國，唯有透過各大小網路網網相連、合作傳遞，才能維持網際網路上資訊流通的順暢。惟我國電信法中的網路互連義務僅適用於第一類電信事業間以及第一類和第二類電信事業間的網路互連，且將網路互連概念的詮釋限於基礎建設的實體互連及透過公共交換網路傳輸的語音服務互連，並不適用於第二類電信事業間的網際網路數據服務互連。著眼於ISP產業的健全發展以及整體網路環境的提昇，本文分析現有規定不足之處，並建議將網路互連概念擴及至網際網路數據服務的互連，同時修正電信法的規範，明確地將網路互連義務的適用擴及至第二類電信事業間。

The topic of the Internet interconnection settlement is of significant importance, especially in Taiwan, because the Internet is a network of networks and the exchange of traffics of each internet end-user can only work under the interconnection agreement of ISP's. However, The Taiwanese Telecommunication Law only imposes the interconnection obligation on the Type I telecommunication business. Moreover, the regulation on the interconnection settlement only applies to the interconnection of the physical telecom apparatus and that of the public circuit switch networks used to provide the traditional telephony service. For the well beings of the ISP market in Taiwan, this essay argues that the concept of interconnection shall be applied to the Internet interconnection. Also, the Telecommunication Law shall be amended to impose the interconnection obligation on the Type II business.
