毛利人和英國皇室在 1840 年簽訂『懷坦吉條約』在紐西蘭社會
與憲政及法律上具有舉足輕重的作用，奠定了毛利人與歐洲白人
（Pākehā）之間的關係以及和其他族群共同居住在這塊土地之依據，
也奠定了紐西蘭的憲政體系成為英國政治架構的基礎。而一般人權
與法律或政治學者將紐西蘭毛利人與外來侵入殖民者的和平共楚機
制視為一個值得參考的典範，然而也有許多研究指出毛利原住民權
利雖是受到殖民者的高度保障，但並非因此而產生真正的族群和諧，
因此檢視『懷坦吉條約』的歷史脈絡有助於探究其殖民與被殖民的
張力與其產生原因的相關性解釋。
本文聚焦於『懷坦吉條約』，全文以此條約來探討毛利原住民與
Pākehā 所發展的夥伴關係或者是國中之國的觀念，並以其後續相關
條約與相關事件來看原住民族集體權對於土地與環境的保障與其產
生之認同動力。

The Māori, the indigenous peoples of New Zealand, signed a Treaty
with the British in 1840, known as the Treaty of Waitangi. The Treaty has
been seen as New Zealand’s founding document. This paper looks at the
history of the treaty and discuss the essential issues that were argued
between Māori and the British Crown as well as what both sides hoped to
obtain by agreeing to the treaty. The paper concludes with some
reflections for an ongoing discussion for scholars and activists who are
concerned about the land rights and collective memory of indigenous
peoples.
