隨著資訊科技發展與網際網路普及化,透過網路下載數位內容產業儼然成為新趨勢,不法業者將電影支解,利用「BT程式」或檔案服務輕易下載、上傳,網路盜版比實體通路販賣仿冒品對智慧財產權的侵害更為嚴重。根據國際智慧財產權聯盟(International Intellectual Property Alliance, IIPA)2009年度特別三○一建議名單中針對智慧財產權保護,亞洲國家被認為是侵犯智慧財產權最甚者,是經濟損失最大區域,值得注意的是,中國名列特別301其中,臺灣今年首次被排名在外,兩岸對盜版態度表現差異化。一部電影,本質仰賴創意為基礎,創意則透過適當的法律制度以智慧財產的形式呈現,但是盜版問題卻嚴重侵害電影價值。在種種緣由與現況下,國內許多產、官、學研究影音盜版的相關議題,以了解其嚴重程度,本研究採用計劃行為理論為基礎,分析兩岸使用者對於網路盜版電影下載意願之差異。盜版行為以大專院校學生為主要使用群體,故本研究以大專院校生為研究樣本,透過發放網路問卷,收集臺灣地區156份有效問卷,中國地區152份有效問卷,利用結構方程模式驗證研究架構內各變數間之關聯性,討論使用者在使用檔案分享平臺交換音樂檔案時的可能行為模式,以期能夠給予電影業者合適的建議。
With the development of computer technology and widespread of internet, the firm problem goes more serious. According to the American 2009 special 301 list, Asian countries are notorious as the world’s worst violators of intellectual property rights. It is noteworthy that China is still on the special 301 list, but Taiwan out of this year. The two area of the piracy attitude is differentiated. A movie intrinsically consists of creativity, but piracy problem is very serious to encroach on the film value. The difference with past, user’s piracy behavior in P2P model are not only downloading, but also sharing. The main purpose of this research is to analyze the behavioral difference on download movie file in Taiwan and China. This study proposes a model based on the Theory of Planned Behavior to understand what factor affect intention toward download movie file. As college Students are primary users, so this study took students as our research samples. Through internet questionnaire and SEM to discuss the behavior model of using P2P file exchanging software further, except to offer suitable suggestions to the firm industry.
